Augustine Morales was killed by Sacramento Police Department Sergeant Jeremiah Jarvis on November 14, 2020, while attending a neighborhood event. The police statement and local news said that Augustine was brandishing a weapon and pointing it at people. However, unedited video footage shows otherwise.
Augustine was escorted out of the event building for being intoxicated. While Augustine was inside another building, there was a commotion (someone had a gun) inside the event which lead to the attendees running out of the building to seek cover. Augustine is then seen walking out of the other building with a gun and is seen walking around the parking lot. The Family believes he was trying to protect himself and others as he appears to be thinking of what to do next. Suddenly, someone inside the event building begins shooting. Let's be clear, Augustine NEVER fired his weapon. Augustine takes cover between two parked cars, close to the entry of the building where the shots were fired. The Sac PD sergeant is then seen running behind Augustine and without any warning or voice commands, recklessly fires his weapon into Augustine's back, unloading his weapon and hitting Aug eleven (11) times. We say recklessly because the officer was shooting in the direction of the crowd and he did not assess the surroundings to ensure that there were no other people or children between the cars with Augustine. AFTER shooting 13 rounds, the officer prompts Augustine to drop his weapon, which was already on the ground (as seen in the video - you can see the magazine unloaded from the weapon). The officer proceeds to give Augustine multiple commands, with which Augustine complies. Augustine continuously says, and his last words are, "I didn't shoot no one".
We don't want JUSTICE. We NEED JUSTICE!
The actions of the officer are UNCONSTITUTIONAL, he denied Aug his 2nd, 5th, 6th, 8th, and 14th Amendment Rights:
2nd - "...Right of the people to keep and bear Arms..."
5th - "...RIGHT TO LIFE, Liberty, or Property, without due process of law..."
6th - "... Right to a speedy and public trial and an impartial jury. (innocent until proven guilty)..."
8th - "... nor cruel and unusual punishments inflicted..."
14th - "... nor shall any State deprive any person of LIFE, liberty, or property, without DUE PROCESS..."
The officer violated the 8th Amendment since Aug was not protected against cruel and unusual punishment. If being shot in the back eleven times without warning, is not considered cruel and unusual, I don't know what is. I don't know what is more cruel than being shot in the back.
Augustine did not deserve to die for holding a gun. Which is our 2nd Amendment Right!
We will fight for Justice.
